Please read these Terms of Service carefully before using the CheckMyFit mobile application. By downloading, installing, or using the App, you agree to be bound by these Terms.
1. Acceptance of Terms
By accessing or using CheckMyFit, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the App.
2. Description of Service
CheckMyFit is a virtual try-on application that uses artificial intelligence to generate previews of how clothing items would look on you. The service includes:
- Virtual try-on feature using AI-generated images
- AI-powered style review and recommendations
- Gallery to save and organize your virtual outfits
- Virtual wardrobe to manage your clothing items
3. User Conduct
You agree to use CheckMyFit only for lawful purposes. You must not:
- Upload photos containing nudity or sexually explicit content
- Upload photos of minors (anyone under 18 years old)
- Upload photos without the consent of the person depicted
- Use the App to create misleading or deceptive content
- Attempt to reverse engineer, hack, or compromise the App's security
- Use the App in any way that violates applicable laws or regulations
We reserve the right to terminate your access to the App if you violate these terms.
4. Subscriptions and Payments
CheckMyFit offers subscription plans to access premium features:
- Weekly: 4.99 EUR per week
- Yearly: 99.99 EUR per year
All subscriptions are processed and managed by Apple through the App Store.
Billing: Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
Cancellation: You can cancel your subscription at any time through your Apple ID account settings.
Refunds: All refund requests are handled by Apple. To request a refund, visit reportaproblem.apple.com.
5. Intellectual Property
Our Content: The App, including its design, features, code, and content is owned by CheckMyFit and protected by intellectual property laws.
Your Content: You retain ownership of photos and content you upload. By uploading content, you grant us a limited license to use, process, and store it solely to provide the service to you.
AI-Generated Content: Images generated by our AI based on your photos are provided for your personal, non-commercial use.
6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.
We do not warrant that the App will be uninterrupted, secure, or error-free, or that AI-generated images will be perfectly accurate.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CHECKMYFIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.
8. Indemnification
You agree to indemnify and hold harmless CheckMyFit from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
9. Termination
We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the App will cease immediately.
10. Governing Law
These Terms shall be governed by and construed in accordance with the laws of France. Any disputes arising from these Terms shall be resolved in the courts of France.
11. Changes to Terms
We reserve the right to modify these Terms at any time. Your continued use of the App after changes constitutes acceptance of the new Terms.
